Advertising Purchase & Reservation of Space

• I understand and agree that advertising space in the 2026 Yosemite Celtic Festival Souvenir Program is not guaranteed until payment has been received.
• I understand that space is limited and may be sold on a first-come, first-served basis.
• I understand that Yosemite Celtic Festival reserves the right to determine final program layout, page order, and advertisement placement unless a specific premium placement has been purchased and confirmed in writing.

Artwork Deadline & Submission Requirements

• I understand and agree that all completed artwork must be submitted by the published deadline.
• I understand that late artwork may not be included in the Souvenir Program.
• I understand that failure to submit artwork by the deadline does not entitle me or my business to a refund, credit, transfer, substitution, or future advertising placement.
• I understand that I am responsible for submitting print-ready artwork in the requested size, format, and resolution.
• I understand that if my artwork does not meet the required specifications, Yosemite Celtic Festival may request revisions or make reasonable adjustments when possible; however, Yosemite Celtic Festival is not responsible for redesigning, correcting, rebuilding, or creating my advertisement.

Proofing & Accuracy

• I understand and agree that I am responsible for reviewing all names, phone numbers, websites, QR codes, spelling, pricing, offers, dates, addresses, logos, images, and any other information included in my advertisement.
• If a proof is provided, I understand that approval of the proof confirms the advertisement is ready for publication.
• I understand that Yosemite Celtic Festival is not responsible for errors, omissions, outdated information, broken links, incorrect QR codes, misspellings, incorrect pricing, or inaccurate details submitted or approved by me or my business.

Ad Content Approval

• I understand and agree that Yosemite Celtic Festival reserves the right to refuse, remove, or request changes to any advertisement that is inappropriate, misleading, political in nature, offensive, adult-themed, discriminatory, unlawful, or not aligned with the family-friendly and community-focused nature of the event.
• I understand that acceptance of payment does not guarantee acceptance of submitted advertisement content.

Printing & Production Variations

• I understand and agree that printed materials may vary from digital proofs or submitted files.
• I understand that Yosemite Celtic Festival is not responsible for minor variations in color, image quality, trimming, layout, sizing, paper appearance, or final printed result that may occur during the printing or production process.
• No Cancellations, No Refunds, No Credits, No Transfers
• I understand and agree that all advertising purchases are final.
• I understand and agree that no cancellations, refunds, credits, transfers, substitutions, or future advertising placements will be issued for any reason.
• This includes, but is not limited to, failure to submit artwork by the deadline, change of business plans, dissatisfaction with placement, dissatisfaction with print results, inability to provide artwork, business closure, event changes, or any personal, business, technical, logistical, or financial circumstances.

Liability Limitation

• I understand and agree that in the event of an error or omission caused by Yosemite Celtic Festival, the festival’s liability will be limited to the amount paid for the advertisement.
• I understand and agree that Yosemite Celtic Festival is not responsible for indirect losses, lost sales, loss of business, reputational harm, loss of opportunity, loss of exposure, or any other damages.

Copyright, Trademark, Artwork Use & Submitted Materials

• I understand and agree that by submitting artwork, logos, photographs, graphics, written content, QR codes, trademarks, business names, slogans, or any other materials for publication, I represent and warrant that I own the materials or have secured all necessary rights, licenses, permissions, and releases to use them.
• I understand and agree that I am solely responsible for all content and materials submitted for my advertisement.
• I understand and agree that Yosemite Celtic Festival, Kimberly Vaughan Enterprises, LLC, the event venue, and their respective officers, members, employees, volunteers, contractors, agents, representatives, successors, and assigns shall not be held liable for any claims, disputes, damages, costs, or expenses arising from copyright infringement, trademark infringement, unauthorized use of artwork, unauthorized use of photographs, unauthorized use of logos, misrepresentation, privacy or publicity rights violations, licensing issues, or any other misuse of submitted materials.
• Indemnification Agreement
• I agree to indemnify, defend, and hold harmless Yosemite Celtic Festival, Kimberly Vaughan Enterprises, LLC, the event venue, and their respective officers, members, employees, volunteers, contractors, agents, representatives, successors, and assigns from any and all claims, liabilities, demands, damages, losses, expenses, and costs, including legal and attorney fees, arising from or in any way related to my advertisement, my submitted materials, my business, my products or services, my claims or offers, or any actions or omissions by myself, my employees, agents, contractors, representatives, or business associates.

Permission to Publish

• I grant Yosemite Celtic Festival permission to publish the advertisement and submitted materials in the 2026 Yosemite Celtic Festival Souvenir Program.
• I understand that submitted materials may also be used in related event production, promotional, administrative, or archive materials connected to the Souvenir Program or the event, unless otherwise agreed in writing.

Agreement and Legal Acceptance

• By purchasing advertising space, submitting payment, submitting artwork, or providing advertising materials, I confirm that I have read, understand, and agree to these Advertising Terms & Conditions.
• I understand that this agreement is legally binding and applies to me, my business, and any employees, agents, contractors, representatives, or business associates connected to my advertisement.
